Abstract

English judicial opinion rejects the doctrine of informed consent and the extent of disclosure applied in American and Canadian courts. However, recent court decisions have revealed a difference of opinion as to how the English standard of duty to disclose should be determined. Basically the choice is between a standard determined by the courts and a standard of practice accepted by a body of skilled and experienced physicians, even if a contrary view exists.
