The present report contains the result of a research project on 'Technology assessment with regard to the environment' which was commissioned by the Federal Ministry for Research and Technology (BMFT) and carried out jointly by the GSF Research Centre for Environment and Health (GSF) and the Institute for Applied Innovation Research (IAI). In this project the Law on Protection from Harzardous Substances (Law on Chemicals) was used to exemplify the procedure of assessing the consequences of legislation in the area of environmental law. The project proposal distinguished three project phases. In the first an exemplary ex post analysis was to be carried out on a significant legal regulation (the Law on Chemicals) concerning a specific branch of industry generally considered innovative (the chemical industry). In this way it was intended to collect empirical knowledge on how regulations affect innovation processes in the individual company. In the second phase the planned amendment of the Law on Chemicals was to serve as a case example for an assessment of the consequences of legislation. In the third project phase the methodology employed in the former was to be extended for the purpose of developing an instrumentarium for the ex ante assessment of legislation. Such an instrument could permit both the corporate innovator and the innovation promoter to assess the effets of environmental legislation at the corporate level and thus develop an anticipatory conflict management. (orig./SR) / Der vorgelegte Bericht beinhaltet die Ergebnisse des vom GSF-Forschungszentrum fuer Umwelt und Gesundheit (GSF) und dem Institut fuer Angewandte Innovationsforschung (IAI) gemeinsam bearbeiteten BMFT-Forschungsvorhabens 'Technikfolgenabschaetzung - Umwelt'. Thema war die Gesetzesfolgenabschaetzung im Bereich der Umweltschutzgesetzgebung am Beispiel des 'Gesetzes zum Schutz vor gefaehrlichen Stoffen (Chemikaliengesetz)'. Der Projektvorschlag sah dabei vor, zunaechst in einer ersten Projektphase exemplarisch eine ex post-Analyse in einer als innovativ einzustufenden einzelwirtschaftlichen Branche (der Chemieindustrie) anhand einer signifikanten gesetzlichen Regelung (dem Chemikaliengesetz) durchzufuehren, um so Erfahrungswissen ueber Regelungen und deren Auswirkungen auf den einzelbetrieblichen Innovationsprozess zu sammeln. Darauf aufbauen sollte in einer zweiten Phase exemplarisch - anhand der geplanten Novellierung des Chemikaliengesetzes - eine Gesetzesfolgenabschaetzung durchgefuehrt werden, um so in einer dritten Projektphase eine methodische Erweiterung hinsichtlich der Entwicklung eines Instrumentariums zur ex ante-Abschaetzung von Gesetzen zu entwickeln, das sowohl dem einzelbetrieblichen Innovator als auch dem Innovationsfoerderer erlaubt, Wirkungen gesetzlicher Umweltregelungen auch fuer die einzelbetriebliche Ebene einschaetzen zu koennen, um so ein vorausschauendes Konfliktmanagement zu ermoeglichen.
