Abstract

Mentally retarded patients of a state-owned health care facility in New York brought suit claiming that the programs and services provided them were inadequate and that psychotropic drugs were administered as a substitute for proper care. The U.S. District Court, Northern District of New York, dismissed their claim in part but allowed them to proceed on grounds of a possible violation of constitutional due process and equal protection requirements. The District Court recognized the general right to treatment in appropriate therapeutic settings that least restrict personal liberty, as set forth in the U.S. Supreme Court decision, Youngberg v. Romeo.
