Abstract
This article analyses the laws relating to the payment of divorce benefits to the former spouse upon divorce and recent amendments to the South African Government Employees Pension Law Amendment Bill. It will further evaluate the payment of divorce benefits before and after the Bill. It will further analyse the definition of pension interest with specific reference to relevant statutory provisions and case laws jurisprudence. It will also finally clarify whether between the member spouse and former spouse, who is responsible to pay tax upon divorce.
