Abstract

The question of whether congenital defects constitute harms to the children who bear them is examined through an analysis of the concept of harm. Morreim finds inadequate the prevailing "otherwise-condition" approach which denies that we can predicate harm of such defects, and she suggests a new direction which the analysis of harm might take. She reviews legal rulings in recent wrongful life cases in a lengthy footnote.
