Abstract

The California Legislature approved a bill that would protect municipalities from prosecution for operating needle-exchange programs. The bill passed in September, and granted public entities, their agents, and their employees an exemption from prosecution if their municipality has declared a public health emergency related to HIV. Public opinion polls in the State show that most Californians favor the programs as a means of preventing HIV transmission. Additional information on legislation in other States, regarding needle-exchange programs, is provided.
