COMMISSION Of THE EUROPEAN COMMUNITIE: REVISED VERSION APPLIES TO THE FRENCH, GERMAN AND ENGLISH VERSIONS Proposal for a COUNCIL DIRECTIVE COM(86) 146 final/2 Brussels, 6 June 1986 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the pursuit of broadcasting activities (submitted to the Council by the Commission) COMC86) 146 final/2 User Rectangle -1- EXPLANATORY MEMORANDUM I. Scope and purpose of the proposal for a directive 1. The main purpose of this proposal for a directive is to permit broadcasts, particularly television broadcasts, which comply with the directive's requirements to be received and re- transmitted freely in all Member States. Once the directive enters into force, any broadcast complying with the laws of the Member States in which it originates should then be able to circulate freely throughout the Community unrestricted by divergent national requirements 1n the receiving States concerning broadcast advertising and youth protection since the directive will have coordinated the Laws of the Member States in those areas. The coordination proposed takes the form of a Limited number of rules constituting the minimum necessary for the protection of the different interests in cause. The Member States accordingly will remain free to impose stricter or more detaiLed requirements on broadcasts originating on their own territories (Articles 13(2) and 16). 2. This proposal provides for the approximation of the laws of Member States: - on the production of television programmes within the Community; -on the distribution of such Community works by television broadcasters; - on broadcast advertising and sponsoring; - on copyright in retransmission of broadcasts by cable; - on the protection of children and young persons; -on the law applicable to broadcasts. 3.
